Tourist service provider: shall mean a tourist subject, who offers accomodation capacities and/ or other tourist services on the visitslovenia.net web portal.

Web portal operator: shall mean the company Polet d.o.o., which incorporates offer and demand of tourist services in Slovenia on its web portal, and enables, by using an implemented booking system, a direct possibility to reserve accommodation capacities and other offers, or purchase tourist services.

User: shall mean a visitor of the web portal www.visitslovenia.net who uses the booking system in order to make a purchase, or guarantee reservation of accommodation or other offers.

Web portal: shall mean the web portal www.visitslovenia.net, which incorporates the offer and demand of tourist services in Slovenia. It also offers the possibility of making direct reservations or executing purchases of tourist services.

These general terms of business apply for reservations and purchases made through the web portal.

The contract relating to individual services is always concluded between the user and the tourist service provider. The web portal operator does not offer any accommodation facilities or other services on its own responsibility and only guarantees accurate operating of the booking system on the web portal. The web portal operator, therefore, cannot be held liable for the realization of reservations made through this system.

The prices of services are determined by the tourist service provider and are valid from the day of their publication on the web portal. All prices on the web portal include VAT (value added tax).

Prices of accommodation or tourist packages include the services listed in the web portal. In the description, the tourist service provider is obliged to indicate all additional services and costs, which are not included in the basic price, as extra costs. The prices are published in Euro per person per day or per accommodation unit per day, depending on the accommodation unit type. In the rest of the tourist offers, the prices apply to a package or offer (vacation packages, last minute offers, gift certificate).

The tourist service provider retains the right to change the published prices on the web portal. The users, who have already received a confirmation notice about their reservation, will be charged according to the prices determined at the time of the confirmation. In the case of price reduction, the user is not entitled to a refund in the amount of the difference between the price determined at the time of booking and the price currently determined on the web portal.

Web portal operator reserves the right to cancel the reservation / purchase if there was an obvious mistake in the published price. In this case, the user will receive back the already payed amount.

The guest is obliged to pay the tourist tax in compliance with the Promotion of Tourism Development Act together with the accommodation payment. The tourist tax is not included in the price of tourist services, unless stated otherwise. The tourist tax is paid directly to the service provider, namely per person per night.

Individual reservations are made through the following procedures:

a) Directly (on-line), without any prior inquiry at the tourist service provider through the web. When making the reservation, the user is bound to send all data demanded by the reservation procedure, and pay non-refundable reservation prepayment cost in order to secure the reservation. Some providers demand that reservations are paid in full immediately. In this case the conditions provided in Article 9: Reservation cancellation shall apply.

b) On inquiry, for those accommodation facilities which are described on the web portal, but are, on the provider’s request, unavailable for direct reservation. This might happen during the period of increased demand or for the reason of insufficient accommodation capacities.

In such case, the user is obliged to send an inquiry directly to the tourist service provider. The tourist service provider is obliged to reply in a period of 48 hours whether the requested accommodation is available or not. In the case of available accommodation capacities, the tourist service provider is obliged to make an optional reservation for a period of 48 hours – the time period during which the user decides whether to confirm the optional reservation through the web portal or not. If the tourist service provider dos not reply about the availability of his capacities in a period of 48 hours, or if the accommodation is not available during the requested period, the web portal operator is at liberty to offer an alternative accommodation to the user.

After the execution of payment, the tourist service provider and the user will automatically receive a reservation notice to their e-mail address.

The web portal operator is at liberty to charge to the user the reservation prepayment cost (includes VAT) for some reservations made through the web portal.

The reservation prepayment cost is calculated for each reservation on the basis of the final price paid by the user. As soon as the user makes the payment, the web portal operator guarantees to successfully process the requested reservation.

The reservation prepayment cost is calculated only once during the process of making a reservation and is independent of subsequent changes in number of nights, services and other factors.

The tourist service provider is bound to issue to the user a receipt for the services reserved through the web portal. The price on the receipt must be reduced by the amount of the reservation prepayment cost that was already payed in advance. The final payment is made under the business terms and conditions determined by the tourist service provider.

The web portal offers the following types of payment:

a) Only the reservation prepayment cost is payed on the web portal. The user pays the difference in price directly to the provider.

b) Some providers demand that the reservation on the web portal is paid in full in advance. Additional costs, e.g. tourist tax and other costs (insurance, enrolment fee, etc.) are subsequently paid directly to the provider.

c) Gift certificates are paid in full immediately. The web portal operator is at liberty to charge the shipping & handling costs.

The payment of reservations or purchases on the web portal is possible by credit cards, or through Pay Pal payment system. The payment day shall be considered the day when the user makes the payment by his/her credit card or through the Pay Pal system.

Users can cancel their reservation through the link stated in the received e-mail. Registered users of the web portal will be provided with an opportunity to cancel their reservation through their personal membership pages. The tourist service provider will be automatically informed about the cancellation by e-mail.

In the event of cancelling the reservation which has been paid fully in advance, the reversal costs are calculated as follows:

  • Cancellation more than 14 days prior to arrival: the return of reversal costs in the amount of 80 % of the total reservation value;
  • Cancellation from 14 days to 7 days prior to arrival: the return of reversal costs in the amount of 60% of the total reservation value;
  • Cancellation from 7 days to 3 working days prior to arrival (during the business hours of the web portal operator): the return of reversal costs in the amount of 40% of the total reservation value;
  • Cancellation less than 3 working days prior to the arrival (during the business hours of the web portal manager), and in the case of no-show: reversal costs are not calculated;
  • Users are entitled to a return of reversal costs in the amount of 80% of the total reservation value in the event of no-show or cancellation only in cases of "higher force" and if they submit an official document explaining the reasons for their cancellation.

Cancellation of the reservations which have been paid only partially does not bring any return of the reversal costs. The reservation prepayment cost is irreversible.

The user is bound to notify the tourist service provider about any reservation changes. All contact data of the tourist service provider is stated in the e-mail which the user receives after the completed reservation.

The user pays the full price of gift certificate immediately. The web portal operator shall send to the user a self-designed certificate with all necessary data. The certificate will be valid in all establishments of the chosen service provider, or at the proposed location and under the terms published by the provider on the web portal. The user shall receive instructions explaining where and how to use the gift certificate.

Gift certificates are issued by name and are not transferable on third persons. It is necessary to use the gift certificate prior to the expiry date stated on the certificate. Certificates are usually valid for a period of a year, but not necessarily. Certificates are no longer valid after the expiry date. Each certificate can be used only once and must be submitted to the tourist service provider before using the service for which the certificate was issued.

It is not possible to reverse the issued certificates. Certificates can't be changed for cash or other certificates.

Purchased certificates on the web portal, including all documentation, shall be delivered to the user by the company Pošta Slovenije, d.o.o. (national post of Slovenia). Gift certificates shall be forwarded to the post on the following day after receiving the payment.

The use of the value-based gift certificates visitslovenia.net is carried out in accordance with the instructions given to the user together with a gift certificate.

Users can receive credits for the completed reservations / purchases and can use them for the following reservations / purchases. In the case of cancelling the reservation / purchase, the gained credit is no longer available. The web portal operator is permitted to void all received credits in case of no show.

The promotion code brings a specific bonus for a reservation / purchase in the form of a discount, which refers to a particular provider or offer.

Promotion codes and credits need to be used within the validity period on the third step of the reservation / purchase process. Credits and promotion codes can be without any exception used only up to the amount that needs to be payed on the web portal.

a) The booking system is based on electronic procedures which can be disturbed. Consequently, the web portal operator can only be held liable for any breach of obligation in the event of intent or negligence. If the access to the web portal is prevented due to"higher force" or the web portal technical maintainer, both parties agree that none of them is to be held liable for the damage which might occur.

b) The tourist service provider undertakes to receive reservations and purchases made through the web portal, and guarantees the tourist service under the agreed conditions.

c) The tourist service provider has the right to change reservations in the cases which cannot be predicted or avoided. In such cases, the provider reserves the right to change the reserved accommodation with a similar accommodation of the same or even better quality for the same price which was confirmed at the time of reservation. In the case that the user does not agree with the offered accommodation, the user and the tourist service provider agree about the costs. The web portal operator cannot be held liable for the changes made by the service provider.

d) Misleading and false data given by the tourist service provider about the category (number of stars), accommodation capacities, accommodation equipment, location, distance and other data can result in suitable claims for price reduction. The web portal operator cannot be held liable for any deficiencies in executing the user’s demands resulting from the false data given to the web provider by the tourist service provider.

e) Tourist service provider offers discounts on some age classes of guests (children, seniors), that are calculated in the reservation price. Therefore, the user is obliged to communicate accurate information regarding the age of guests (the correct choice of age groups) at the time of visit. Incorrect data on age may lead to price increases afterwards.

a) Accommodations on the web portal are categorised in compliance with the categorisation of the ministry responsible for tourist affairs, namely:

  • Hotels and camps with one, two, three, four or five stars;
  • Motels, private hotels, lodging houses, apartments- holiday apartments, holiday houses with one, two, three of four stars;
  • Farms with accommodation capacity with one, two, three or four apples.

Only the categorisation based on the valid rules relating to the accommodation facilities (Ur.l.RS, no. 62/2008) shall be taken into consideration.

b) Individual providers can be evaluated by users. The provider’s final evaluation is a sum of individual estimation of users, who estimate each provider according to several criteria. The right to estimate individual providers is given only to those users who have already made use of the services. The web operator reserves the right to not take the given evaluations into consideration, particularly, if there is a suspicion of a positive or negative manipulation. During the evaluation process, personal data is neither considered, nor stored.

The user must put forward all complaints directly at the location of the service. Users are obliged to notify the tourist service provider about possible complaints immediately after they find an irregularity. In the opposite case, the provider is not obliged to consider the claim.

The web portal operator cannot be held responsible for the claims which can be solved only between the user and tourist service provider. If the claim was not solved on the spot, despite the tourist provider’s effort to do so, the web portal operator does not guarantee that the claim shall be solved.

Until the tourist service provider gives a definite response to the claim, the user must abstain from including third parties in the procedure (arbitration, court establishments, etc.) and transmitting information to media.

The web portal operator does not include inadequately registered tourist providers in the service sale. This also applies for the accommodation providers who have not obtained adequate national categorisation of their facilities or regulated statuary provisions for their service.

All statements have been gathered with outmost integrity. We cannot be held liable for potential mistakes which have occurred during the process of gathering or transmitting data. Without obtaining a written permission from Polet d.o.o., it is not permitted to transmit any data, not even partially, to other data holders, or use the data for the purposes which are not envisaged in these general terms of business.

The photos on the web portal are symbolic.

In the event of any dispute arising between the parties, all parties shall accept the jurisdiction of the courts in Ljubljana.

General terms of business are valid from 1st February 2009 onwards, until revocation. Polet d.o.o. reserves the right to change the general terms of business.
